Terms & Conditions

The following terms and conditions apply to your purchase of products from CMSPRODUCTS.COM ("CMS"). By placing your order, you agree to be bound by these terms and conditions, which constitute the entire agreement between you and CMS regarding the products purchased.

1. Ordering: Your order is subject to acceptance by CMS and may be refused for any reason, including credit concerns, unusual volumes, or shipping addresses. Once accepted, CMS may make partial shipments if some items are on backorder. By placing the order you agree that CMS may do so and charge you for any items shipped.

2. Pricing: The price for each product purchased is reflected on your order and will remain the price regardless of any subsequent price changes by CMS. In addition to the quoted price, you will pay shipping and handling charges according to your selected shipping method plus all applicable taxes, except where there is a special "Free Shipping" promotion in effect. For the purpose of calculating sales tax, the location to which the product is to be shipped shall govern. You will only be charged one shipping and handling charge for each order regardless of the number of shipments.

3. Taxes: CMS collects and remits sales tax, where applicable, on all orders based on shipping method selected and location. Orders that have been placed without tax exempt status cannot receive credit for tax paid.

4. Cancellation: Orders may not be canceled for items available for immediate shipment. Items on backorder may be canceled up to the actual shipment date, which may differ from CMS' estimated shipment date.

5. Payment: CMS accepts payment in via credit card on our web site. Your card will not be charged until CMS ships the product to you. At the time of order, your credit card is approved for the amount of the sale. The sale is finalized and processed when the product has shipped.

6. Shipping: CMS will ship products according to your selected shipping instructions. CMS will ship product Monday-Friday 8-5 p.m.. Orders will be processed and shipped within 48 hours, pending approved credit. Orders received between Saturday and Sunday will be processed on Monday. If CMS learns it cannot ship within the estimated times, you will be advised via email of the new estimated shipment date. For items on backorder, CMS may ship whenever the product becomes available without any notice to you. CMS does not ship products to PO boxes.

6a. International Shipping: CMS does export from the United States, however, all orders placed using non-U.S. credit cards are screened with the issuing bank. CMS requires billing address verification from the issuing bank prior to order release. Shipping cost estimates on all International orders are emailed to the customer separately following placement of orders. International orders are released upon confirmation/acceptance of shipping costs and address verification.

7. Additional Handling Charges - CMS may assess additional handling charges if incorrect address information is provided.

8. Duties: Orders from outside the United States are subject to appropriate import duty charges.

9. Title: Title to all products passes to you upon delivery of the product to the selected carrier.

10. Money back guarantee: CMS offers you a limited 30 day money back guarantee on all non-software products purchased through CMSPRODUCTS.COM with the exception of ABSplus, which has a limited 90 day money back guarantee. Should you wish to return the item for any reason, you must call CMS Customer Service at 1-714-424-5520 to receive an RMA number and must do so prior to the end of the 30th day following shipment of the product by CMS. All returns must be in the original CMS packaging and contain all items provided with the product.

10a. Refunds on Software Downloads: There are NO REFUNDS on downloadable software. Customers should contact CMS Products before purchasing downloadable software if they have any questions regarding the product. Customers should carefully study the product information before purchasing.

11. Returns: After the 30 day period you may only return the product pursuant to CMS' limited warranty terms. All returns must be in the original CMS packaging and contain all items provided with the product.

12. Warranty: All CMS products come with a limited warranty the terms of which are incorporated into these terms by this reference.

13. Limitation of Remedies and Liability: THE REMEDIES PROVIDED HERE ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF THIS AGREEMENT BY CMS. IN NO EVENT WILL CMS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES. IN NO EVENT WILL CMS' LIABILITY TO YOU EVER EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU TO CMS FOR THE PRODUCTS PURCHASED.

14. Additional terms: This agreement is governed by California law. CMS is not responsible for typographic errors. CMS reserves the right to change these terms or the prices charged at any time so please check each time you purchase.
